Today’s whistleblower.
Hello Graham,
I have just posted this on Sainsbury's internal internet site for all colleagues who are employed by the company. It refers to their policy on Supporting Trans Colleagues at Work -I have attached a copy of the policy.
I intend to resign from my position at Sainsbury's tomorrow so while I would be delighted if you highlight the company in the 'Cry of Glinner' I would really appreciate it if you did not name me please.
Thanks for all that you do!
Best regards,
(name redacted)
Is Sainsbury's breaking the law?
In an effort to improve the company rating on the Stonewall league table, Sainsbury's has introduced a policy that changes single-sex toilets and changing areas to allow everyone to use 'the facility they feel most comfortable in' as stated in the policy, 'Colleague Guide to Supporting Trans Colleagues at Work' version 1
According to the policy, [transitioning] 'Individuals may choose to defer surgery for a period of time or not have it altogether'. Effectively, Sainsbury's are now inviting male-bodied people to use the existing female changing area and toilets.
As far as I am aware, this has been implemented without consultation with female colleagues. Last month I raised my concerns with the Head of Inclusion and I also raised my concerns with my Line Manager at the recent Great Place to Work meeting.
To put this into context, NHS Lanarkshire, after consultation with Stonewall, tried to implement a similar policy that gave male bodied people access to female toilets and changing areas. When female employees raised concerns, Barrister Sarah Phillimore took up the case as reported in the Mail online on 14 August stating that:
'It's unlawful. It places primacy on trans rights and ignores female sex which is a protected characteristic.'
(Sex is a protected characteristic under the 2010 Equality Act)
NHS Lanarkshire removed the policy on 28th August.
So the question is, by implementing this policy could Sainsbury's be acting unlawfully too?
The only thing I’d say is DON’T RESIGN. You have the Equality Act on your side. Make them fire you and then take them to court.
Supermarkets eh?? Freakin co-op is at it as well. TRA has complained about them posting ads in the Spectator as it publishes "transphobic" articles so they have decided to pull all advertising from the Spectator! On the basis of one complaint from an activist! I'm a member of the co-op so intend to pursue this with them.
Are they going to do the same for the public toilets?
