My GP is proud to announce that they are a “Pride in Practice” award-winner. I wrote and asked if they would guarantee me intimate examinations by a natal woman and that I did not consent to a non-natal woman examining me and absent specific contrary consent would consider it an assault.
To their credit, they did get advice on the point and this is the advice they got. I love the final sentence. Effectively they are denying me treatment?

I have raised your query to a policy directorate within the BMA ethics team to seek further advice and have received the following response :
Firstly, a transgendered medical professional is under no obligation to inform the practice they work at that they are transgender. Such information is subject to strong privacy rights. Therefore, from a purely practical level, the practice cannot accede to the request as they may not know whether the gender identity of their staff is the same as what was assigned to them at birth. To presume identity on the basis of appearance would potentially expose the practice to legal action. According to current guidance from the General Medical Council, a patient may request – although does not have a right to - a ‘male’ or ‘female’ practitioner. Such requests often arise in relation to intimate examination and are not necessarily regarded as discriminatory. No further information is provided on this point, though it is worth noting that when an individual transitions they legally acquire the status of their ‘new’ gender identity. A trans woman is, therefore, legally female. The fact that someone may have transitioned is information private to them and nobody, including employers, has a right to access that information without the individual’s consent. Furthermore, in our view, to accede to the request would very likely discriminate against staff and would breach current UK equalities legislation. Therefore, agreeing to the request would be both potentially discriminatory and practically challenging. Even if a practice knew the gender identity of their staff they could not necessarily factor this into decisions. The request therefore cannot and should not be accommodated.
